A recently-filed lawsuit handled by attorneys Andrew Miltenberg and Damon Cheronis demonstrates how school administrators tend to overcorrect. According to the complaint, Loyola University Chicago allegedly granted a no-contact order based on an interview and without any follow-up investigation to make up for “losing a student’s sexual assault complaint.”

Loyola used the single-investigator model “wherein a single individual both investigates and adjudicates the claim.” In a case that seemed to turn mostly on credibility, Loyola’s investigator also had a hard time granting Doe’s cross-examination questions:

The complaint also mentions a survey illuminating the lack of support accused students receive, compared to the generous and zealous support received upon accusers:

The lawsuit was just filed and the university has yet to respond.
